Your Agreement with AptlyWorn

By using aptlyworn.com (the "Site"), operated by AptlyWorn (hereinafter referred to as "we", "us", or "AptlyWorn"), you agree to these Terms of Service. If you do not agree, please do not use the Site.

Permitted Use of AptlyWorn

You may use the Site for lawful purposes only. Purchases are for personal, non-commercial use.

Prohibited Uses

You agree not to use our website or services for any unlawful purpose or any purpose prohibited by these Terms. Prohibited uses include, but are not limited to:

  1. Illegal Activities: Any activity that violates any applicable law, regulation, or ordinance, including but not limited to fraud, money laundering, or identity theft.
  2. Harmful Acts: Uploading, transmitting, or distributing viruses, malware, ransomware, or any other harmful code that could damage, disable, or impair our systems or the systems of other users.
  3. Automated Access: Using bots, crawlers, scrapers, spiders, or any automated scripts to access, monitor, or copy our website content without prior written permission.
  4. Security Violations: Attempting to gain unauthorized access to our servers, databases, user accounts, or proprietary systems; interfering with the integrity or performance of our website.
  5. Harassment and Abuse: Harassing, threatening, abusing, defaming, or intimidating any person or group; posting or transmitting offensive, hateful, or discriminatory content.
  6. Unauthorized Data Collection: Collecting or tracking personal information of other users (including email addresses, phone numbers, or addresses) without their explicit consent.
  7. Resale and Commercial Use: Reproducing, duplicating, copying, selling, reselling, or exploiting any portion of our website or products without express written permission, except for personal, non-commercial use.
  8. Misrepresentation: Impersonating any person or entity, falsely stating or misrepresenting your affiliation with any person or entity, or providing false information.
  9. Interference: Interfering with or disrupting the normal operation of our website, including through denial-of-service attacks, excessive requests, or any means that could damage our infrastructure.
  10. Reverse Engineering: Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code of any software or proprietary technology used on our site.

Violation of any of these prohibited uses may result in immediate termination of your access to our website and/or legal action.

Account Termination by AptlyWorn

AptlyWorn reserves the right to terminate or suspend your access to the Site and our services at our sole discretion, without prior notice, for any conduct that we believe:

  • Violates these Terms.
  • Harms our business, reputation, or other users.
  • Is unlawful or fraudulent.

Upon termination, your right to use the Site will immediately cease. Any pending orders may be canceled and refunded at AptlyWorn's discretion.

Intellectual Property Rights of AptlyWorn

The Site and its entire contents, features, and functionality are owned by AptlyWorn and are protected by United States and international copyright, trademark, and other intellectual property laws.

Orders & Payment

Placing an order constitutes an offer to purchase. AptlyWorn reserves the right to refuse or cancel orders due to product availability, pricing errors, suspected fraud, or violation of these Terms.

Order Cancellation

You may request to cancel your order within 2 hours of placement if the order is placed during our service hours (Monday – Friday, 9:00 AM – 5:00 PM CT).
If your order is placed outside of service hours, you may cancel by emailing us by 10:00 AM CT the next business day, as long as the order has not yet been processed.
If your order has already been processed or shipped, cancellation is no longer possible; however, you may still return the item within 30 days for a full refund using our standard return process.

Pricing Errors

While we strive for accuracy, product prices may occasionally be listed incorrectly due to system or human error. If a product's displayed price is clearly erroneous, we reserve the right to cancel the order and issue a full refund. You will be notified promptly.

Shipping & Returns

Free shipping on orders totaling $70.00 and above. Flat $5 for orders totaling $69.99 and below. 30-day free returns on eligible items. See full policies for details.

Sales Tax

All product prices exclude sales tax. Sales tax is calculated based on the shipping destination. As an Alabama-based business, sales tax is automatically calculated and collected for orders shipped within Alabama. For other states, tax will be calculated at checkout only if required by local state regulations.

DMCA Takedown Policy

If you believe that any material on our Site infringes your copyright, please submit a written DMCA notice to info@aptlyworn.com.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall AptlyWorn, its directors, employees, partners, suppliers, or agents be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with your use of or inability to use the Site.

In no event shall AptlyWorn's total liability to you exceed the total amount actually paid by you to AptlyWorn for the specific product giving rise to the claim.

Dispute Resolution Process

Informal Resolution: Before filing a formal claim, you agree to contact us directly at info@aptlyworn.com. We will work in good faith to resolve any dispute within 30 days.

Binding Arbitration: Any dispute arising out of these Terms shall be resolved exclusively by binding arbitration under the American Arbitration Association (AAA) Consumer Arbitration Rules, conducted in Jefferson County, Alabama, or via telephone/online.

You and AptlyWorn agree that each party may bring claims only in an individual capacity, not as a class action.

Arbitration Fees: If you initiate arbitration, AptlyWorn will reimburse your filing fee up to $500.

Opt-Out Right: You may opt out of this arbitration agreement within 30 days by emailing info@aptlyworn.com with "Arbitration Opt-Out".

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Alabama and the applicable federal laws of the United States, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Jefferson County, Alabama. You agree to submit to the personal jurisdiction of such courts.
